This is an agreement between you and Fountain City Trashcan Valet LLC (and its affiliates, “Fountain City” or “we”). Before using Fountain City, please read these Fountain City Terms and Conditions of Service, the Fountain City Privacy Notice, the Fountain City Recurring Payment Terms and Conditions, and other applicable rules, policies, and terms posted on the Fountain City website or available through your Fountain City app (collectively, this “Agreement”). By using Fountain City, you agree to be bound by the terms of this Agreement. If you do not accept the terms, you may not use Fountain City.
By enrolling in Fountain City’s valet service, you agree to contract with Fountain City LLC to manage the placement and return of your waste and recycling cans at the specified address. This is a monthly service contract, and you agree to pay for the service monthly in advance.
For the purposes of these Fountain City Trashcan Valet LLC Terms and Conditions of Service:
“Fountain City” refers to the waste and recycling management service, including the Fountain City app and related services.
“Helpers” or “Valets” refer to persons employed or contracted by Fountain City to provide the service.
“Software” includes all software, updates, or related documentation provided for use with Fountain City.
By subscribing, you authorize Fountain City and its helpers to access your property (or designated location) to take out and return your waste and recycling cans. You confirm that you have the right to grant access. It is your responsibility to ensure Fountain City or its helpers can access your cans on the scheduled service dates. If we are unable to provide service due to lack of access, no credit or refund will be given, though a one-time reschedule may be requested within 24 hours at our discretion.
You agree to pay Fountain City the current monthly recurring service fee plus applicable taxes. As of June 24, 2022, the base service fee is $39.99, which may be adjusted at Fountain City’s discretion.
Currency: All payments must be made in United States Dollars (USD). We do not accept payments in any other currency.
Fountain City reserves the right to adjust pricing. If the price changes, we will notify you 2 months in advance, giving you the option to cancel if you do not accept the new price. Continued use of the service will be considered acceptance of the updated pricing.
Fountain City will place for pickup and return to your designated area, one waste can and one recycling can per week for your property’s designated trash day, for a flat monthly fee. This includes two service visits per week, for a total of eight visits per month.
You must ensure that access codes, gate combinations, or pets are taken care of to ensure our helpers can access your cans. If access is blocked, no service will be provided, and no refund will be issued for that week.
Service is billed on a recurring monthly basis at the beginning of each month. Unless you cancel, billing will continue each month to ensure uninterrupted service. All applicable local, state, and federal taxes will be added to the recurring fee.
By accepting these terms, you agree to enroll in the Fountain City Payment Plan, authorizing automatic payments to the payment method you have provided. Service renews automatically according to the plan you have selected (monthly, every 6 months, or every 12 months).
It is your responsibility to ensure your payment method is current. If a payment fails, Fountain City will retry daily for up to 20 consecutive days. If unsuccessful, Fountain City may continue attempts for two consecutive months or suspend service.
Your subscription will automatically renew at the end of each payment plan period unless you cancel in advance. Payments will be charged according to the current rates at the time of renewal.
You may cancel your service by giving 1 month’s advance notice, except where special volume pricing applies. Cancellation must be completed online at [service link] or via email at help@canmonkey.com. No partial credit or refunds will be provided for cancellations after the billing cycle has started. Special volume pricing requires a minimum of 3 months’ notice.
In case of exceptional circumstances (such as illness, relocation, or emergencies), Fountain City may consider a prorated refund or waive the notice period requirement. Documentation may be requested.
A cancellation fee may apply if the service is terminated before completing any minimum commitment period. Fountain City reserves the right to waive these fees at its discretion.
You are responsible for keeping pets away from the service area on your scheduled service day to ensure the safety of our helpers. Fountain City is not liable for service failures due to pets interfering with access.
Fountain City will carefully place your cans curbside for city pickup. However, Fountain City is not liable for any damage caused to vehicles or property as a result of cans being hit by vehicles or knocked over. Nor is Fountain City responsible for any damages due to acts of nature, fire, vandalism, or misuse of the cans.
The homeowner is responsible for ensuring compliance with local regulations, such as fencing and gate codes, waste lines, and other safety standards. Fountain City is not liable for any fines, penalties, or compliance failures in relation to local safety codes.
We strive for complete customer satisfaction. If you are dissatisfied with a service, you must notify us within 7 days to address the issue. Fountain City will investigate and work to resolve your complaint as soon as possible.
Fountain City may change, suspend, limit, or discontinue its services or any part of them at any time without notice. Changes to these terms may also be made at Fountain City’s discretion. Continued use of Fountain City after any changes constitutes acceptance of those changes.
If the serviced property is used as a short-term rental, Fountain City will not be liable for any Homeowner Association (HOA) fines related to trash can placement or management. The customer assumes full responsibility for compliance with all HOA rules and regulations.
Any dispute arising from or related to this Agreement is subject to binding arbitration under the terms specified in Fountain City Terms and Conditions. By using Fountain City, you agree to resolve disputes through arbitration.
Fountain City is not responsible for any damage to your waste or recycling cans or property caused by acts of nature, fire, vandalism, or misuse. We are also not responsible for vehicle damage caused by collisions with cans placed for collection.
Monthly Subscription:
Cancellation Notice: If you cancel your service more than 1 month before your next billing date, a refund will not be issued, as the service is prepaid.
Partial Refunds: If cancellation occurs less than 1 month before the billing date, no refund will be provided for the unused portion of the monthly subscription.
Special Cases: In the event of a service disruption caused by Fountain City (e.g., failure to provide service), a prorated refund for the affected period may be issued at the discretion of Fountain City.
Non-Refundable Items:
Fees related to missed service pickups, account reinstatement after cancellation, or administrative charges are non-refundable.
Fountain City Discretion: Fountain City reserves the right to waive or adjust refund amounts or cancellation fees at its discretion.
6-Month Subscription:
Early Cancellation: If you cancel within the first month of your 6-month plan, a prorated refund will be provided for the unused months, minus any applicable cancellation fees.
After 1 Month: No refunds will be offered after the first month of the subscription period.
Special Volume Pricing: If you have special volume pricing, a minimum of 3 months’ notice is required to cancel and be eligible for any refund. Failure to provide the necessary notice may result in forfeiture of any refund.
12-Month Subscription:
Early Cancellation: If canceled within the first 3 months, a prorated refund may be offered, minus a cancellation fee for early termination.
After 3 Months: No refunds are provided if the cancellation occurs after the first 3 months of the 12-month plan.
Special Volume Pricing: The same terms apply as with the 6-month subscription.

These Promotional, Discount, and Trial Offer Terms and Conditions (“Promotional Terms”) apply to all promotional, discount, and trial offers provided by Fountain City Trashcan Valet LLC (“Fountain City,” “we,” or “us”). By participating in any Fountain City promotion or discount offer, you agree to these terms in addition to our Terms and Conditions.
Fountain City offers promotional discounts on long-term subscription plans to reward customer loyalty. The following discounts are available:
20% Discount: Applied to the pre-tax price of an annual (12-month) subscription.
15% Discount: Applied to the pre-tax price of a six-month subscription.
To be eligible for the promotional discounts:
The subscription plan must be purchased directly through the Fountain City website or mobile app (coming soon!).
The discount applies only to new or renewing subscriptions and cannot be applied to partial subscription periods or mid-term changes.
Discounts apply only to the first billing period of the subscription (either six or twelve months), after which the subscription will renew at the regular price unless otherwise specified.
The promotional discount is valid from the date of purchase and applies for the entire duration of the selected subscription period (either 6 or 12 months).
Fountain City reserves the right to end or modify any promotional offers at any time. However, any customers already subscribed under an existing discount will retain the discount for the duration of their current billing period.
The discount is automatically applied when you select the six-month or twelve-month subscription during checkout. The total price displayed will reflect the 15% or 20% discount, respectively.
The discount applies only to the subscription fee. It does not apply to any additional fees, including installation fees, service add-ons (such as the Lock ‘N Roll Securement Strap), taxes, or other charges.
Discounts and promotional offers are non-refundable. If you cancel your subscription before the end of the promotional period, no prorated refunds will be given for the unused portion of the discount.
If you cancel your six-month or twelve-month subscription early, the following applies:
No refunds or partial credits will be provided for unused months.
Your subscription will be terminated at the end of the current billing period, and you will not be billed for future months.
You will not be eligible for the promotional discount again unless otherwise specified by Fountain City.
At the end of the discounted subscription period:
